General sales conditions

All orders for products accepted by Cierzo Brewing Co. are in accordance with the following General Conditions of Sale that will form part of the Sales Contract. The acceptance of the products will imply the acceptance of these General Conditions of Sale.

Prices and payments

The prices reflected on our website include the I.V.A. Cierzo Brewing Co. reserves the right to vary the price of the items without prior notice according to market conditions. All purchase invoices / delivery notes are payable on the date shown therein. Payment must be made by the means indicated at the time of the order and in € uros.

Availability of products

Cierzo Brewing Co. will use its best resources to comply with the agreed delivery dates, but these will only be estimates, and therefore will not affect the nature of this contract.

Legal warning

The current sales conditions regulate the agreement between Cerveza Artesana Rasmia SL, duly registered as a company, and the client, which they formalized through the website www.cierzobrewing.com for the acquisition of products from Cierzo Brewing Co. through the Site Web.

Contracting procedure

2.1. Eligibility to buy

In order to place an order through the Website, the Customer must be of legal age (over 18 years) and must be the end customer. Minors are expressly excluded.

2.2. How to order

To place an order through the Cierzo Brewing Co. website you must follow these steps:

1. Choose the products you want and add them to “My cart”.
2. Check out.
3. Enter delivery and payment information.
4. Choose the payment method and click “Send order”. By pressing the “Send order” button on the order form, the Client fully and unreservedly accepts all the Conditions of sale that appear on the Website at the time of contracting.
5. Make the payment.
6. If the payment is authorized, the customer will receive a confirmation of receipt of the order. Except in the circumstances described in Sections 2.3 and 2.4 below.

It is recommended that the Client print and / or keep a copy of the Conditions of sale when ordering.

A copy of the confirmation of receipt will be sent to the Customer’s email address. We recommend that you print or download a copy for future reference.

Cierzo Brewing Co. may change the Terms of Sale at any time, without prior notice to the Customer. However, if an order is canceled for any of the above reasons, Cierzo Brewing Co. will refund (if applicable) the value of the order. Shipping costs will be reimbursed with the exception of products that must be returned to our office, where shipping costs will be borne by the buyer. In addition, when the Customer has received confirmation of receipt by Cierzo Brewing Co. of their order, the Sales Conditions applicable to it cannot be changed.

2.3. Availability of products

Each order is made to measure and to order.

2.4. Right of Cierzo Brewing Co. to cancel or not accept an order

In cases such as:

• The payment information provided was incorrect or unverifiable.
• The security systems indicate that the order is abnormal or may be fraudulent.
• There are reasons that indicate that the Client is a minor (under 18 years of age).
• Cierzo Brewing Co. was unable, after 3 attempts, to deliver the order to the address provided.

If an order is canceled for any of the above reasons, Cierzo Brewing Co. will refund (if applicable) the value of the order. Shipping costs will be reimbursed with the exception of products that must be returned to our office, where shipping costs will be borne by the buyer.

2.5. Data verification

Before processing an order made by the Client, Cierzo Brewing Co. can verify the data of the same. This may mean verification of the Customer’s address and creditworthiness and whether there may be any fraud involved. Regarding possible fraud, Cierzo Brewing Co. may use a partially automatic verification of all purchases to filter out those deemed abnormal or suspicious and those suspected of fraud. Suspected fraud requests will be investigated, and the Client may be reported to the appropriate authorities, who may be able to take action against the Client.

Price and payment

3.1. Prices and currency

The prices and offers presented on the Website include VAT (Value Added Tax) and are only valid for orders placed online through the Website. These prices and offers may not coincide with those available in Cierzo Brewing Co. stores around the world.

3.2. Way to pay

To pay the order the Client can use the Lyra virtual platform. The charge will be made after confirming the order.

3.3. Changes in price

The prices that appear on the Website are subject to change. Cierzo Brewing Co. reserves the right to change prices without notice. However, upon receipt of the order confirmation from Cierzo Brewing Co., the prices payable for such order will not change.

Cierzo Brewing Co. informs you that despite meticulous updates to Website prices, they may contain errors. All errors that appear in the prices will be corrected promptly.

3.4. Value Added Tax

In order to comply with the VAT applicable according to the rules on distance selling, deliveries will be considered to be made in the Member State that appears at the delivery address.

In this way, all purchases made through the Website will be subject to VAT. VAT will be applied in the legal percentage in force in the Member State where the goods for a specific order will be delivered.

Customers from outside the territories where VAT is applied: according to the VAT policy of Cierzo Brewing Co., VAT will be charged to customers in that purchase area who make the purchase through the Website when ordering.

Delivery

4.1. Delivery: where and when

Deliveries are made Monday through Friday. No deliveries are made on weekends or during local holidays.

4.2. Delivery term

Delivery times are between 2 and 7 business days, Cierzo Brewing Co. reserves the right to make delivery outside these periods in the event of an anomaly that prevents it. Regardless of whether the delivery occurs before or after that period, the cost of the delivery will not be modified. As for the inconveniences that may arise to the contracted transport company, we do not take on additional delays.

Attention: Delivery times urgently and exceptionally on request.

4.3. Verification upon receipt

The Client must verify the status of the package upon receipt. If the packaging is damaged, the Customer must not accept delivery. The purchase amount and shipping costs will be reimbursed to the Customer when the warehouse has processed and returned the products. Cierzo Brewing Co. advises that delivery must be verified within a reasonable period of time upon receipt. In the event that no rejection of the products has been received within 10 days of delivery, Cierzo Brewing Co. will consider that the Customer has accepted it.

Shipping costs

Shipping costs are applied to each order, these being made only in Spanish mainland.

Returns

You can only request the cancellation of an order within 60 minutes after making the payment and confirming the order, after this period of time the order is considered to be in progress and its cancellation will not be possible.

Validity of offers (“Promotional Offers”)

Promotional offers displayed on the Website to increase the sale of certain products are only valid while appearing on the Website, unless otherwise specified therein.

Responsibility

9.1. These Terms of Sale establish all the obligations and responsibilities of Cierzo Brewing Co. regarding the supply of products. There are no guarantees, conditions, or other terms that are binding on Cierzo Brewing Co., except those expressly mentioned in the Terms of Sale.

9.2. Subject to clause 9.3, the maximum joint liability of the parties to each other in all claims of any kind or related to these Conditions of sale, whether in the contract, warranty, condition, tort, strict liability, law or other form, WILL BE LIMITED TO THE AMOUNT PAID TO Cierzo Brewing Co. FOR THE PRODUCT CONCERNED.

9.3. Nothing in these Terms of Sale limits or excludes Cierzo Brewing Co.’s liability against (i) death or personal injury caused by the negligence of Cierzo Brewing Co., (ii) fraud, (iii) any breach of the obligations implied by the national laws in force or (iv) any liability that cannot be excluded by law.

Applicable legislation

Purchases made through the Cierzo Brewing Co. Website and under these Terms of Sale are subject to Spanish law.

Competent jurisdiction

Any dispute or discrepancy that arises from the application or interpretation of the Sales Conditions, as well as the contracts that it incorporates, will be resolved in the courts of the city of Zaragoza, Spain, which will have exclusive jurisdiction over any other jurisdiction. However, if the Client enjoys the consumer status according to the Spanish Law for the defense of consumers and users, the competent courts will be those of the consumer’s place of residence in Spain.
